Consent considerations
Under the Fair Credit Reporting Act (FCRA), an employer is required to comply with several regulations , including:
- A form must be signed by an applicant before a prospective new employer may perform a background check on the applicant using an outside for-profit firm, including search engines on the Internet.
- The form must be a standalone document, separate from the actual employment application.
- The employer must let the applicant know a background check will be used in the decision-making, and is required to provide a copy of their summary of rights under FCRA.
- The applicant must also provide a written form, separate from the application, with a space for them to include their personal information: name, address, date of birth, and Social Security number, if required for the type of background that you wish to obtain.
- Keep the written authorization form within applicant’s file to verify you have been given permission, should the proof be needed
